Aetiket Label Printer - License Agreement

Please read the license agreement below. By installing or by using Aetiket Label Printer you accept all the terms and conditions of this license agreement. If you do not accept the terms of this license, close the Aetiket Label Printer program and remove the Software from your computer's memory. 1. License The Aetiket Label Printer program, including any files, images incorporated in, and data accompanying the program ("The Software"), is licensed to you by Eric Fandrich. (a) You are encouraged to install and use one copy of the Software on a single computer. The Software may be used by more than one person on that computer. (c) You may also make a copy of the Software to use on a portable or home computer which is primarily used by yourself. (b) If you have licensed a site version of the Software, you are allowed to install the software on a storage device such as a network server, to run the Software on an internal network for the use of the licensed number of users only. 2. Distribution You may copy the Software for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices. (a) You may distribute this program freely as long as no fee is charged. (b) The Software may not be included in any for-profit software compilation or bundled with any other for-profit package, except with prior written consent from the author, Eric Fandrich. (c) The Software may be distributed freely on on-line services and by users groups, except where noted above, provided it is distributed unmodified and in the original archived format. (d) If you wish to include the Software on a CD-ROM as part of a freeware/shareware collection, Web browser, or book, I ask that you send me a complimentary copy of the product. 3. License Restrictions You may not decompile, reverse engineer, disassemble, or otherwise reduce the Software to a human-perceivable form. You may not modify the Software or create derivative works based on the Software. You may not rent, lease, or sublicense the Software. 4. Ownership The foregoing license gives you limited rights to use the Software. Eric Fandrich does not hereby transfer title to the Software. Eric Fandrich retains full and complete title to the Software and any copies made by you, and all intellectual property rights therein. 5. Termination This license is effective until terminated by either party. You may terminate this agreement at any time by removing the Software from the memory of the computer into which the Software has been transferred, and by destroying all materials obtained from Eric Fandrich and all related documentation and all copies and installations thereof. This agreement will terminate immediately without notice from Eric Fandrich if in Eric Fandrich's sole discretion you fail to comply with any term or provision of this agreement. Upon termination, you must destroy all materials obtained from Eric Fandrich and all copies thereof, whether made under the terms of this agreement or otherwise. 6. Disclaimer You hereby acknowledge that you are solely responsible for selecting the Software and that the Software may not satisfy all of your requirements or be free from defects. THE SOFTWARE AND ANY MATERIALS, INFORMATION, AND DOCUMENTATION ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, ERIC FANDRICH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, AS TO NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, MERCHANTABILITY, OR FITNESS FOR ANY PARTICULAR PURPOSE. ERIC FANDRICH DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SOFTWARE OR THE RELATED FILES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE SOFTWARE REMAINS WITH YOU. YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. 7. Limitation of Liability Under no circumstances, including, but not limited to, negligence, shall Eric Fandrich be liable for any special or consequential damages that result from the use of, or the inability to use the Software (including, without limitation, damages for loss of business profits, business interruption, loss of business information, and the like), even if Eric Fandrich has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall Eric Fandrich's total liability to you for all damages, losses, and causes of action (whether in contract, tort, or otherwise) exceed the amount paid by you, if any, for the use of the Software. 8. General This agreement shall be governed by and construed in accordance with the laws of the State of Illinois, DuPage County. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the subject matter herein and shall not be modified except in writing, signed by Eric Fandrich. 9.
